Overview

Welcome to Excellent Tiling Services. In these Terms of Service ("Terms"), "we", "us" and "our" refer to Excellent Tiling Services Pty Ltd (ABN 63 150 082 054). We operate this online store at excellenttilingservices.com, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, set out your rights and responsibilities when you use the Services and buy from us. By using the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

These Terms apply to products purchased through our online store. If we agree to provide any tiling, renovation or installation work, that work is covered by a separate written quote or agreement.

Requesting a quote or a measure through the Services, or booking a showroom visit or pickup time, does not create an order or a contract for work. A quote only becomes binding when we both accept it in writing. Showroom visits and pickups are by appointment only, Monday to Saturday, 4:30 pm to 9 pm.

1. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms, or in any of our policies, excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Where any part of these Terms would otherwise do so, it applies only to the extent permitted by law.

2. Access and your account

By agreeing to these Terms, you confirm that you have the legal capacity to enter into a binding contract.

To use the Services or buy products, you may be asked to provide information such as your name, email address, phone number, billing, payment and delivery details. You agree that the information you provide is correct, current and complete.

If you create an account, you are responsible for keeping your login details secure and for activity on your account. You may not transfer, sell or assign your account to anyone else.

Trade accounts. Businesses with an active ABN can apply for a trade account. We approve applications at our discretion. Once approved, trade prices are shown and applied automatically when you are logged in to your trade account. Trade pricing does not combine with other discount codes, and it is for purchases made in the course of your business. We may change trade pricing or close a trade account at any time, for example if the account is used for non-trade purchases or shared with others. Any order already accepted keeps the price shown when it was placed.

3. Our products

We aim to describe and display our products accurately. However, colours and appearance may look different on your screen depending on your device and settings. Tiles and natural materials can also vary in shade, tone, pattern and texture. If you are unsure about a product, please contact us before ordering.

Product descriptions, specifications and availability may change. We may discontinue a product at any time and may limit the quantities of any product we offer.

4. Orders

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance. We may decline an order, for example if a product is unavailable, if there is an error in the price or description, or if we are unable to deliver to your location. If we decline or cancel an order after you have paid, we will refund the amount you paid for that order.

Please review your order carefully before submitting it. Some products are ordered in from our suppliers after you order, so we may not be able to accommodate cancellation or change requests once an order has been accepted. Please contact us as soon as possible if you need to change or cancel an order.

Returns and refunds are handled in accordance with our Refund Policy and the Australian Consumer Law.

You may buy products for your own use, including for use in projects you carry out for your own clients (for example, as a tiler, builder or renovator).

5. Prices and payment

Prices are shown in Australian dollars. Prices, discounts and promotions may change without notice, but the price you pay is the price shown at the time you place your order, as set out in your order confirmation. Any applicable delivery charges and taxes are shown at checkout before you pay.

We may run promotions from time to time that have their own terms. If there is a conflict between a promotion's terms and these Terms, the promotion's terms will apply to that promotion.

You agree to provide current, complete and accurate payment information and confirm that you are authorised to use the payment method you provide.

6. Shipping and delivery

Delivery and collection are handled in accordance with our Shipping Policy. Any delivery timeframes we provide are estimates only. We are not responsible for delays caused by events outside our reasonable control, but this does not affect your rights under the Australian Consumer Law.

7. Intellectual property

The content of the Services, including text, images, graphics, logos, video and the design and arrangement of the store, is owned by or licensed to Excellent Tiling Services Pty Ltd and is protected by Australian and international intellectual property laws.

You may use the Services for your own shopping and research purposes. You must not copy, reproduce, distribute, modify, republish or otherwise use any material from the Services for commercial purposes without our prior written consent.

Our names, logos and branding are trademarks of Excellent Tiling Services Pty Ltd. Shopify's name, logo and related marks are trademarks of Shopify. Other names, logos and brands shown on the Services belong to their respective owners.

8. Third-party tools and links

The Services may include tools, content or links provided by third parties, which we do not control. Your use of third-party tools or websites is at your own discretion and is subject to those third parties' own terms and policies. To the extent permitted by law, we are not responsible for third-party content, websites, products or services.

9. Relationship with Shopify

Excellent Tiling Services is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Excellent Tiling Services. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Excellent Tiling Services, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Excellent Tiling Services.

10. Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide services to you.

11. Reviews and feedback

If you send us or post reviews, comments, ideas or other feedback ("Feedback"), you give us a non-exclusive, royalty-free licence to use, reproduce, publish and display that Feedback in connection with the Services and our business. You agree that your Feedback is honest, is your own, and does not contain anything unlawful, misleading, offensive or that infringes anyone else's rights. We may, but are not required to, edit or remove Feedback.

12. Errors and inaccuracies

Occasionally, information on the Services may contain errors or omissions, including in product descriptions, pricing, promotions, delivery charges, timeframes or availability. We may correct errors and update information at any time. If an error affects an order you have placed, we will contact you. If we cancel the order as a result, we will refund the amount you paid for it.

13. Prohibited uses

You may use the Services for lawful purposes only. You must not use the Services to: break any law; infringe anyone's intellectual property or other rights; harass, abuse or harm any person; provide false or misleading information; send spam or unsolicited advertising; impersonate any person or entity; upload viruses or malicious code; collect other people's personal information; interfere with or bypass the security of the Services; or use robots, scrapers, AI tools (including agentic AI) or other automated means to access the Services except as permitted in section 14.

We may suspend or close your account or restrict your access to the Services if you breach these Terms.

14. Agents

14.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, without direct supervision.

14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with section 14.4. No Agent may access, use or interact with the Services if we have asked that Agent not to.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including "Agent/[agent name]" in the request's user agent string; (ii) not conceal or obscure that any access, use or interaction is from an Agent, such as by mimicking human behaviour or completing or circumventing CAPTCHAs or other measures intended to distinguish computers from humans; (iii) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.

15. Limitation of liability

Subject to section 1 and to the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the Services, including loss of profit, revenue or data.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including under the consumer guarantees in the Australian Consumer Law.

16. Indemnity

To the extent permitted by law, you agree to indemnify us against any third-party claims, losses and reasonable costs arising from your breach of these Terms, your breach of any law or the rights of a third party, or your misuse of the Services, except to the extent the claim or loss is caused by us.

17. Termination

We may suspend or end your access to the Services if you breach these Terms. Any rights and obligations that by their nature should continue (including sections 1, 7, 9, 15, 16 and 18 to 20) continue to apply after termination. Termination does not affect any order already accepted, or your rights under the Australian Consumer Law.

18. General

Severability. If any part of these Terms is found to be invalid or unenforceable, that part will be read down or severed to the extent necessary, and the rest of these Terms will continue to apply.

Waiver. If we do not enforce a right under these Terms, that does not mean we have waived it.

Entire agreement. These Terms and the policies referred to in them are the entire agreement between you and us about your use of the Services, and replace any earlier version of these Terms.

Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations under these Terms where this does not reduce your rights.

Headings. Headings are for convenience only and do not affect the meaning of these Terms.

19. Governing law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia.

20. Changes to these Terms

We may update these Terms from time to time by posting the updated version on this page. The version that applies to your order is the version in place when you placed that order. Please check this page periodically for changes.
